There are two types of divorce proceedings. One is known as the “Agreed Divorce” where every possible issue is resolved in a written format approved by the Court. If that option is not available for whatever reason, you can seek a divorce through a trial, that can take from a couple of minutes to a couple of days, depending on the issues. - Tennessee law 36-5-101 lists twelve criteria that the court must consider in deciding whether or not, and if so how much, alimony or maintenance and support one spouse is entitled to from the other.
- Tennessee law 36-6-101 requires a divorce court to decide custody based solely on what is in the child’s best interest, whether this be the mother or father of the child.
