Workman's Compensation

An injury on-the-job that was accidental and arising out of the course and scope of one's employment justifies Worker's Compensation. Insurance companies do not voluntarily pay these claims at their fair value; rather they offer a nominal settlement to make the injured worker go away. The insurance company invests premiums it collects from employers in the stock market hoping to reap dividends for its shareholders, rather than paying fair compensation to a worker for an injury. An attorney can usually get three to five times more than a worker could ever hope to achieve on their own. It is the objective of the Worker's Compensation Carrier not to pay any benefits until they are forced to do so by an Attorney, and to pay as little as possible.

It is not uncommon for an insurance company to "play dumb" yet cooperate once an attorney with a sound reputation has become involved in the case. I have actually had an insurance carrier claim that they did not know what the hold-up was in getting benefits paid to a client who had been in the hospital with a broken neck for several weeks until I became involved in the case. The insurance company then became very cooperative and apologetic. There are some very stringent rules on notice, etc., for any injury that is work-related.
