A Death Claim Must Be Timely Made

Society requires money compensation for the loss of a loved one caused by carelessness of another.
Tennessee Jury Instruction 14.30

Wrongful Death damages are of two types:

  • Money losses sustained immediately by the deceased loved one such as pain and suffering and medical bills.
  • Money to be paid for the pecuniary value of the life of your deceased loved one such as a lifetime of loss of wages.

Society requires compensation to a surviving spouse for the death of a deceased spouse.
Tennessee Jury Instruction 14.20

The above jury instruction requires a jury to award money compensation not only for the reasonable value of the deceased spouse’s income, but also for the loss of companionship and acts of love and affection that the surviving spouse has lost.
